A Guardian ad Litem is a person appointed by the court to represent the best interests of a child or children, usually in a Dissolution of Marriage, Paternity, or Modification proceeding.
This is a multi-faceted process that involves :
Investigation
- I will interview the child, parents, teachers, caregivers, and others involved in the child's life.
- Visit the child’s current and/or potential residences.
- Review the child's records (medical, school, psychological, etc.).
- I will observe parent-child interactions.
Recommendation
- I will submit a written report to the court outlining:
- Factual findings
- The child’s needs and preferences (if appropriate)
- A recommended parenting plan or timesharing arrangement based on the child’s best interests
- I may also give oral testimony at hearings when asked.
Court Participation
- I will attend all relevant court proceedings.
- I will make recommendations concerning temporary or permanent parenting plans, timesharing, education, medical decisions, and more.
Advocacy for the Child’s Best Interests
- My role is not necessarily to advocate for what the child wants, but rather for what the GAL believes is in the child’s best interests, considering:
- Emotional and physical safety
- Stability
- Relationship with each parent
- Developmental needs
